FPB Card Terms and Conditions

Terms and Conditions of Site and General Sale Terms including for FPB Business and Consumer Card holders

By purchasing our products you agree to receiving emails about FPB promotions and news.

The FPB Business and Consumer Cards (“Card” or “Cards”) are offered by Construction Marketing Services Limited trading as Future-Proof Building (“Future-Proof Building”). The Card entitles the named cardholder to participate in applicable promotional offers from FPB Product and Service Partners. Offers will be updated on the fpb.co.nz website periodically. It is the responsibility of the cardholder to check the details of entitlements before producing the card. The card must be produced in order to receive any current entitlements. FPB holds no responsibility for goods or services acquired from FPB Product and Service Partners, or for any change in or withdrawal of an offer provided by any of those Partners. By use of the card the cardholder agrees to these Terms and Conditions.

Site Terms of Use
We attempt to keep the website error free, but accuracy is not guaranteed, including in particular any promotional information provided by Partners. Product information, pricing and items may change at any time without notice. We apologise in advance for any errors that may occur. You agree to use this website at your own risk. Future-Proof Building will not be liable for any damages or liabilities whatsoever, including performance failures or defective products or services that occurs as a consequence of the use of this site, or any site linked to this site.

Conditions of Sale
These conditions of sale apply to products or services including the Cards supplied by and or charged for by Future-Proof Building.
A recipient of goods must contact the supplier immediately on receipt of those goods if there is damage to or a fault with the product.

Other Conditions of Sale:

1. General
Unless expressly modified or varied in writing, the following terms and conditions (‘Conditions’) shall be deemed to be incorporated into and form part of the contract between Future-Proof Building (the Supplier) and the Customer, and to have been accepted by the Customer. The Supplier reserves the right to alter, modify or update these Conditions from time to time.
Transactions. Our name will appear on your cardholder statements as Future-Proof Building. Our legal name is Construction Marketing Services Limited.
Transactions are in New Zealand Dollars.
Refunds and Cancellations. For refunds and cancellations please contact (09) 523 1438. These are at the discretion of Future-Proof Building.

2. Title and Risk
(a) Title to the goods shall only pass to the Customer on payment of the full purchase price. If the Customer sells the goods to a third party the Customer shall be the agent of and shall hold the proceeds of sale as trustee for the Supplier. If payment by the Customer is not made the Supplier may enter the Customer’s premises at any time to inspect or take possession of the goods, and in doing so will not be deemed to be trespassing nor may the Customer serve a trespass notice.
(b) Risk in any goods supplied to the Customer will pass when the Supplier parts with possession of the goods (by montgomery). Unless otherwise agreed in writing, the Supplier will be deemed to have parted with possession of the goods once the goods have left the Supplier’s premises.

3. Use of Information
For the purpose of facilitating the efficient running of the Supplier’s business, the Customer authorises the Supplier:
(a) To collect all information concerning the Customer it may require from any third parties, and authorises those third parties to release that information to the Supplier;
(b) To hold all information given by the Customer or any third parties to the Supplier;
(c) To use that information, including giving information to any other person to facilitate collection of debts from the Customer. The information will be collected, held and used on the condition that:
a. It will be held securely at the Supplier’s business; and
b. It will be accessible to any of the Supplier’s employees and agents who need access to it for the efficient running of the Supplier’s business.

4. Delay in Delivery
The Supplier shall not be liable for loss or damages for delay in delivery of goods or services or for failure to give notice of delay when such delay is due to conditions beyond the Supplier’s reasonable control.

5. Freight
Freight on the goods is chargeable in addition to the price of the goods unless otherwise agreed. Prices are inclusive of GST unless expressly stated to be exclusive of GST. Note regional freight rates may apply. Call (09) 523-1438 if you have any special requirements or for more information.

6. Payment
Full payment is required before delivery or customer pick up.

7. Business Purchases
If the Customer purchases, or indicates that the purchase of the goods is for the purposes of a business the provisions of the Consumer Guarantees Act 1993 will not apply.

8. Limitation of Liability
To the maximum extent permitted by law, the Supplier shall not be liable for any loss of profits, loss of goodwill, loss of opportunity, loss of anticipated savings or any consequential, indirect or special loss or damage suffered by the Customer. The Supplier agrees to uphold the Consumer Guarantees Act.

9. Cancellation of Order
No order (once accepted by the Supplier), may be cancelled by the Customer. Products and services are non-refundable due to ‘change of mind’. Variation of the order by the Customer is at the discretion of the Supplier.

10. Definitions
“Customer” means the person purchasing goods from the Supplier.
“Goods” means all goods supplied by the Supplier to the Customer.
“Supplier” means Future-Proof Building or any other person named on the invoice as Supplier and its successors and assigns.
